Elder Law & Special Needs Planning

The special needs of persons with disabilities and the elderly necessitate specialized legal services.

Our elder law and special needs planning attorneys enhance our trust and estate planning services to provide highly specialized expertise on a number of legal issues specific to seniors and individuals with disabilities. We understand that compliance with the technical rules is imperative in this domain, and our attorneys are dedicated to keeping abreast of constantly changing regulations.

One of the most pressing fears for seniors is affording long-term care. We work with clients to ascertain their long-term care objectives, assess financial ability to finance such objectives and identify and procure eligibility for available long-term care benefits.  For clients with disabilities or clients with family members with disabilities, we are skilled at creating special needs trusts and supplemental needs trusts to preserve eligibility for means-tested public benefits. We also assist with guardianships and conservatorships when a person is incompetent and unable to manage his or her financial or personal affairs.

Representative Experience

  • Advise and assist clients with eligibility for various public benefit programs, including Medicaid, Social Security Disability Insurance (SSDI), Supplemental Security Income (SSI) and VA benefits.
  • Assist with the creation and administration of special needs trusts, supplemental needs trusts, and other asset protection trusts.
  • Represent petitioners and respondents in contested and non-contested guardianship and conservatorship proceedings, as well as appointed guardians and conservators.
