Johnston Allison Hord attorney Nicki Engel led a breakout session at the 28th Annual North Carolina Bar Association (NCBA) Elder and Special Needs Law Symposium hosted in Greensboro, NC on February 23rd, 2024. Nicki’s breakout session covered recent changes to Chapter 35A of the North Carolina General Statutes which outlines adjudications of incompetence and guardianships. Some of these significant changes include a requirement to consider “less restrictive alternatives” before pursuing guardianship, a new Notice of Rights to be served on the Respondent, changes to guardianship accounting rules, and new tools for effective guardianship oversight and management.
The annual NCBA Elder Law Symposium offers professionals the chance to earn CLE credits and gain insight from premier elder and special needs law practitioners from across North Carolina that they can take back to their respective practices. In addition to Nicki’s program, sessions covered topics including tax law, ethics, the Secure Act, case law updates, and much more.
