Condemnation Rezoning & Land Use

The members of Johnston Allison Hord’s Condemnation and Land Use Practice protect corporate and individual property owners’ rights to own and use real property.

Our condemnation, rezoning, and land use clients include national, regional, and local retailers, commercial developers, car dealerships, solar energy developers, shopping centers, fast food restaurants, theatres, mini-storage facilities, colleges, convenience stores, drug stores, grocery stores, manufacturing plants, wholesale distributors, night clubs, homeowners, and homeowner associations. 

Condemnation (Eminent Domain)

Even the savviest real estate owner can feel overwhelmed when threatened with the taking of his or her business, home, or property for a highway widening, light rail extension, airport expansion, utility line relocation, or other public projects. 

Our attorneys have extensive knowledge of the state and federal laws, procedures, and issues unique to eminent domain.  But our clients also benefit from decades of experience successfully representing owners and tenants similarly impacted by partial or total takings.  We understand how your property will be affected and will fight to reduce the impacts on your property or maximize compensation for your damages.  

Land Use / Property Rights Preservation

Our attorneys appear before City, County, and Town Boards across North and South Carolina to secure rezonings, variances, permits, and other approvals our corporate and individual clients need to maximize the use of their property.  Our representation starts with understanding our client’s goals and includes working closely with other development team members, Planning Staff, the community, and if permissible, Board members, to ensure a path to success.  We vigorously defend clients faced with Notices of Violations or subjected to excessive tax valuations.
