Johnston Allison Hord’s environmental attorneys advise and represent clients in regulatory counseling, litigation, transactional matters, and government interactions providing creative solutions for managing regulatory risks and resolving disputes.

Services Provided

  • Advise clients on regulatory compliance under federal and state environmental statutes, including Clean Air Act, Clean Water Act, Resource Conservation and Recovery Act (RCRA), National Environmental Policy Act (NEPA), and Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA)
  • Assist businesses and individuals with environmental compliance and permitting requirements
  • Represent clients in civil and criminal environmental litigation and enforcement matters
  • Guide clients through environmental due diligence and provide strategic counsel for mergers, acquisitions, and real estate transactions
  • Develop environmental risk management, mitigation, and remediation strategies
  • Coordinate with technical experts and government agencies to ensure compliance and resolve permitting issues
  • Support resource conservation, sustainability practices, and long-term environmental planning

  • Represented companies in reference to compliance issues related to agency inspections, investigations, and notice of noncompliance.

  • Represented Potential Developers in seeking entry into Brownfields program to redevelop underutilized properties while obtaining tax incentives and liability protection from existing environmental concerns.
  • Represented parties to real estate transactions by evaluating property assessments and reports to determine potential exposure, liability, and necessary protections for transactional documents.
  • Reviewed environmental indemnities, warranties and representations in asset sales and purchase transactions.
