Colvin, et. al. v. 84 Lumber Company, et. al.
Johnston, Allison, & Hord, P.A., in collaboration with Tydings & Rosenberg, LLP of Baltimore, Maryland, successfully defended a wrongful death / asbestos claim in the Circuit Court for Baltimore City, Maryland where plaintiff sought joint and several liability against multiple defendants in the amount of $100 Million Dollars in compensatory and punitive damages. After two years of litigation, on July 10, 2014, the Honorable John M. Glynn granted Summary Judgment on behalf of the client-defendant on all direct, cross, and any other claims. The team of David Carson, Michael Hoefling and Gerry Tostanoski (Tydings & Rosenberg) successfully argued, among other things, that plaintiff failed to provide sufficient evidence to support the contention that defendant-client’s products were a substantial contributing factor in causing plaintiff’s asbestos-related disease. Johnston, Allison, & Hord, through its participation with Meritas, a national and global affiliation of independent law firms, worked intimately with its Meritas affiliate firm of Tydings & Rosenberg. Gerry Tostanoski, a partner within Tydings and Rosenberg’s Litigation Department, provided invaluable service as an expert in toxic tort claims within Maryland.
