Marty White won a unanimous decision from the North Carolina Court of Appeals. In a decision filed on January 17, 2017, the Court of Appeals ruled in favor of our firm’s client on the issue of whether a successor developer may compel a municipality to enforce a performance bond that had originally been obtained by a prior developer to guarantee the construction of certain infrastructure improvements. Prior to the case going to the Court of Appeals, Marty had won summary judgment and obtained a dismissal of the lawsuit for our client at the trial court level.
