This article serves as an educational tool for general contractors and attorneys, which will allow them to
understand OSHA, its requirements and the implications of violations. It also serves as a guide through the
procedural aspects of receiving an OSHA violation and the appeal process. The article also discusses a current
trend in OSHA enforcement in North Carolina regarding OSHA inspectors citing general contractors for safety
violations of its subcontractors on multi-employer work sites. The article ends with a discussion of the Woodson
case, which held that employers may be held liable in tort for a work-related injury or death to an employee,
notwithstanding the exclusivity provisions of the Workers' Compensation Act.
