Jury found in favor of JAH client

Marty White recently won a Will Caveat jury trial in Cabarrus County. The decedent executed a Will in 1988 dividing her estate equally between her two children, our client and his sister. Twenty years later, our client's sister had their mother sign a new Will that purported to name the sister as the sole beneficiary of her estate. Our client was unaware of the purported new Will until after Mrs. Miller passed away in 2013. Despite testimony from the attorney who drafted the purported new will, the jury found that our client's mother lacked testamentary capacity to make the new Will and that she signed the new Will as a result of the undue influence of our client's sister. After less than an hour of deliberation, the jury returned a verdict in favor of our client.
