MARTY WHITE successfully represented Ghazi Properties before the N.C. Building Code Council in a landmark decision addressing air rights in the state of North Carolina.
As reported by the Charlotte Business Journal, in question was Mecklenburg County’s assertion that Ghazi's EpiCentre project violated code restrictions due to the separation of the commercial and residential sections of the development. The Council sided with Ghazi in the case, holding that the sale of air rights does not create a lot line for purposes of the North Carolina Building Code.
