Representative Transactions

  • Austin Maintenance & Construction, Inc. v. Crowder Construction Company, et al, 742 S.E.2d 535 (2012). Represented defendant company who provided construction related maintenance services to a third-party against claims of $1 million + for tortious interference with contract, unfair and deceptive trade practices, civil conspiracy and injunctive relief alleged by the plaintiff / competitor. Obtained an Order Granting Summary Judgment in favor of the defendant company and against all claims brought by the plaintiff. Defeated the plaintiff’s appeal of the Order Granting Summary Judgment in a 3-0 decision by the NC Court of Appeals. Post appeal, obtained an award of attorneys’ fees and costs from the trial court against the plaintiff in the amount of $301,435.56.
  • Carolinas HealthCare System v. Wachovia Bank, N.A. et al, Mecklenburg County File No. 08-CVS-2779 (N.C. Business Court). Defense Counsel for Third-Party Defendant in litigation concerning alleged losses of $15 million in a Securities Lending program.
  • Metcalf v. Black Dog Realty, LLC, 200 N.C. App. 619 (2009). Successfully obtained reversal of trial court’s denial of developer’s right to purchase property from City of Asheville. Unanimous Court of Appeals panel directed that summary judgment be entered in favor of developer.
  • Lead Counsel in defense of 15 investors and financial institutions against a $6+ million claim by property owner against developers who sub-divided, sold and developed mountain resort lots on 25 acres of land that allegedly remained owned by plaintiff.
  • Represented southeastern food distribution company in $2+ million construction defect dispute concerning over 900,000 sq. ft warehouse distribution facility.
  • Lead Counsel in defense of $500,000+ claim involving fraud, unfair and deceptive trade practices litigation against a national commercial real estate development company.
  • Lead Counsel in successful settlement of taking by City of Charlotte for South Blvd. Light Rail Corridor. Final award of $1.2+ million.
  • Local Counsel in $80 million construction dispute concerning an EPC power plant project in Puerto Rico.
  • Defense counsel in federal RICO indictment of 12 members of the Outlaw Motorcycle Gang in Charlotte, North Carolina.
